Another Catholic Legal Scholar Endorses Obama


Pro-Life Pittsburgh Catholic Scholar Cafardi Backs Obama

Professor Nicholas Cafardi, a civil and canon lawyer who is a professor and former dean at Duquesne University School of Law, a Catholic university in Pittsburgh, PA, has become the most recent pro-life Catholic legal scholar to endorse Barack Obama for president. He is also a trustee of Franciscan University of Stuebenville (FUS).

Professor Cafardi is no lightweight in Catholic legal thinking and served as legal counsel to the diocese of Pittsburgh for 13 years. He addresses the abortion issue directly and up front. Then he continues to remind us that in 2003, then-Cardinal Joseph Ratzinger (now Pope Benedict XVI) said flatly that "reasons sufficient for unleashing a war against Iraq did not exist." McCain voted for it; Obama opposed it.

He concludes: "I have informed my conscience. I have weighed the facts. I have used my prudential judgment. And I conclude that it is a proper moral choice for this Catholic to support Barack Obama's candidacy."

This archbishop is far too kind in his words about them. They are the scourge and scum of the earth. They whitewash sewage and call it "choice." Fact is, you have already shown to us that when they DO represent The Teaching Magisterium you will reject them (i.e., Archbishop Burke, Archbishop Chaput, Bishop Bruskewitz, etc., etc. who do represent the Teaching Magisterium). BTW the USCCB has no authority within the Catholic Church to do anything. Your knowledge is severely limited.

The USCCB did a great job on that little pamphlet until they put in that little caveat allowing voters to "vote their conscience" concerning "proportionate reasons."

THERE ARE NO PROPORTIONATE REASONS FOR VOTING OBAMA. I KNOW OF NONE AND HAVE ASKED KATHERINE SEVERAL TIMES TO TELL ME WHAT THEY ARE.

An auditor for the Federal Election Commission is attempting to have his bosses seek a formal investigation into the collection by the Obama for President campaign of more than $200 million in potentially illegal political donations, including millions of dollars of illegal, foreign donations, and has sought a request for assistance from the Department of Justice or Federal Bureau of Investigation. But the analyst's requests have largely been ignored. "I can't get anyone to move. I believe we are looking at a hijacking of our political system that makes the Clinton and Gore fundraising scandals pale in comparison. And no one here wants to touch it."

One reasons cited by his superiors, says the analyst, is that involvement by the Justice Department or FBI would be indicative of a criminal investigation, something the FEC would prefer not take place a month before the presidential election. Such actions, though, have been used to scuttle Republican campaigns in the past, the most famous being the Weinberger case in the days leading up to the 1992 re-election bid of President George H.W. Bush.

The analyst, who declines to be identified for fear of retribution, says that on four different occasions in the past three months, he sought to open formal investigations into the Obama campaign's fundraising techniques, but those investigations have been discouraged. "Without formal approval, I can't get the resources I need, manpower, that kind of thing. This is a huge undertaking." And the analyst says that he believes that campaign finance violations have occurred.

The Obama campaign has already had to deal with several FEC complaints about fraudulent donors and illegal foreign contributions, and the FEC says it has no record that those complaints have been resolved or closed. As well, the Obama campaign has been cagey at times about the means by which it has made its historic fundraising hauls, which now total almost $500 million for the election cycle. The Hillary Clinton campaign raised questions about the huge amount of e-retail sales the Obama campaign was making for such things as t-shirts and other campaign paraphernalia, and how such sales were being tracked and used for fundraising purposes. While the profits of those items counted against the $2,300 personal donation limit, there have always been lingering questions about the e-retail system.

"The question has always been, if you buy a $25 t-shirt and you go back to that purchaser eight or nine times with email appeals for $200 or $500 donations, and you have people donating like that all the time, at what point does the campaign bother to check if the FEC limit has been exceeded?" says a former Clinton campaign fundraiser. "There are enough of us from the 1992 and 1996 and 2000 races around to know that many of these kinds of violations never get caught until after the election has been won or lost. In this case, there is no way the Obama campaign will be held accountable before Election Day, unless someone raises holy hell."

The FEC analyst says that Obama's filings indicate he has received large, bundled sums of donations from overseas, sometimes exceeding a quarter millions dollars. "It's suspicious, but it's the small donations made by credit card that need to be examined. We've raised red flags on many of these and the Obama campaign just ignores us. After this election, after we've sifted through everything -- if we're allowed to sift through everything -- I am confident that we are looking at perhaps the largest fine every leveled against a national campaign entity."

I can't believe how so many Catholics allow themselves to become "one issue" voters.

It now makes perfect sense why with 12 years of Republicans in power they were "unable" to make any strides in the abortion atrocity.

Why would a Republican majority push for the change any laws when it's the only thing keeping your voters coming back, right? If I were a Republican looking to get reelected by the middle and lower class majorities who have little to gain from the rest of my upper class policies, I'd hope that Roe v. Wade was never overturned so I could count on those votes no matter what I did.

Exactly! One of the republican hierarchy's not so dirty little secrets is they don't want to totally overturn Roe v. Wade.

They want to keep it as a wedge issue for as longgg as they can along w/gay marriage, gun control etc. because it remains a very good fund raising cash cow for republicans.

Just one of the many scorched earth disingenuous issues republicans use to keep the nation divided between red and blue states ie hate issues and using the fear factor.

It's because they follow the guidlines of the Church. Jesus Christ said that you can obey all the Commandments and fail on only one you will go to Hell. I guess it's because God is a one issue God.

I pray that the Holy Spirit will fill the hearts of those who have made some of the incedinary post.

There are no perfect people in this world - our church leaders included. We all can get into cross-posting links from those who rationalize their votes on abortion. Most Catholics are not one issue voters - they weigh the evidence. To imply otherwise is not looking for the goodness of the Lord that exists in all of our hearts.

In reality - we must make a choice. Is war evil? At times. Is abortion evil? Always. For those those, such as the scholar above - would he have voted against Roosevelt for World War II? Where does our Christian responsibility lie - at our nations borders? Or, as our only Catholic President said,

"Let every nation know, whether it wishes us well or ill, that we shall pay any price, bear any burden, meet any hardship, support any friend, oppose any foe to assure the survival and the success of liberty. "

Our Lord set the example by sacrificing for our sins. We have been greatly blessed in this country, given more by the Almighty than any nation in history. What will we say when asked if we visited those in jail (or freed them from Iraqi prisons), feed those that were hungry (bring opportunity and freedom to the women and children in Iraq). We are truly a noble nation - let us not lose sight of the good that we do. Sometimes we are called upon, like Jesus in the temple, to fight for what is true and right - and pray every night, as Governor Palin does, that we, as a nation, are able to look deep in our hearts, and work to discover God's plan for our lives.

Voting for Obama - one who supports the abandonment of babies during "failed abortions", one who supports the killing of innocents as they are partially delivered is disrepectful of life to the extreme, and not something I shall ever want to have to answer for on judgement day.

I just said a prayer for you and your family - that you continue to grow in understanding the role of the Spirit in your life.

To address your questions:

Would I defend my family in the moment? Of course, with whatever means necessary. Would I pray after the fact that the rapist can find the pathway to the Lord? Absolutely. Every night our family prays not only for those we love, but for those who wish us evil.

For the WWII comment: The point I was making is that war is not always evil - there are times when doing nothing is the greater evil. In hindsight, would it not have been better to crush Nazi Germany before 40-50 million lives were lost? And, in the case of WWII, we were not attacked by Germany, but we ended up losing millions on European soil. We had a much smaller mission in Iraq, with much fewer lives, and God-willing, a positive outcome.

Thus, the US faced similar circumstances in the 1930's and the 1990's/early 2000's. Do we act now and perhaps save lives later, or hope to contain and appease. The lessons of the past century proved appeasement can be the greater evil. There are no crystal balls - but the motives were the right ones, and to oversimplify the lessons and decisions made during both of those events does an injustice to all involved.

Please believe I am pro-life.. from WOMB to TOMB. The "right" people also vote to violate lists of other things that our "one issue God" has declared unfit: Thou Shall Not Kill does not have an amendment saying "except for those people on death row, and civilians, aka. collateral damage." So, really we're not talking about a "God" party vs. the other party - we're talking about picking ONE issue and running with it. You picked abortion. Run with it...I guess it works for you. Go ahead and ignore social justice - you know poverty and health care discussions, but I happen to think that creating a healthy and educated nation is the best way to fight abortion.

A person has made the same case for slavery. Just change the word abortion to slavery and imagine someone saying that they can support David Duke using the same argumentation.

How twisted and deceitful it is to say that you can be prolife and support an individual who says the first thing he would do as president is pass FOCA (Freedom of Choice Act).

BTW, how many bishops have come out and said you can support a candidate who directly supports abortion, FOCA, DOMA, etc?

My point is simply that the same argumentation can be used by anyone to support slavery. Would you vote for a person who says he is anti-slavery and would address the various economic and social concerns to address slavery but would still vote for a federal bill to make slavery legal?

I think the recent document 'Faithful Citizenship' is a fine statement. I do not believe that the Church should be giving voting instructions to the lay faithful or that Church statements should be tortured to produce claims by Catholics telling other Catholics how to vote.

In the final analysis, while I have come to my conclusion, I would never suggest a faithful Catholic could not reach the contrary conclusion.

I think the better counsel would be to suggest Catholics become involved in the political race of their discernment and witness Catholic values within each campaign.
